These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Cashy King ("we," "us," or "our") regarding your access to and use of the Cashy King mobile application and related services (collectively, the "Service" or "Platform").

• Use automated systems, bots, scripts, or scrapers to access the Service
• Reverse engineer, decompile, disassemble, or attempt to derive source code from the application
• Remove, modify, or obscure any proprietary notices, labels, or marks
• Transmit viruses, malware, trojans, or other malicious or harmful code
• Harvest, collect, or store personal information about other users
• Create multiple accounts or use the Service to circumvent usage restrictions
• Engage in any activity that abuses, exploits, or manipulates the Service
• Use the Service to spam, harass, threaten, or harm others

5. Premium Membership

• Grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content

• Warrant that the User Content does not violate any third-party rights or laws

You may not submit User Content that is:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CASHY KING, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE
• DAMAGES RESULTING FROM ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR DATA

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to defend, indemnify, and hold harmless Cashy King and its officers, directors, employees, agents, partners, suppliers, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees and court costs) arising out of or relating to:

• Your access to or use of the Service
• Your violation of these Terms or any applicable laws or regulations
• Your violation of any rights of another person or entity
• Your User Content or any content you submit, post, or transmit through the Service
• Any fraudulent, negligent, or intentional misconduct by you

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

Before filing a claim, you agree to try to resolve the dispute informally by contacting us. If we are unable to resolve the dispute within thirty (30) days, either party may pursue formal dispute resolution.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, rather than in court.

14.3 Arbitration Agreement

You and Cashy King agree that any dispute will be resolved through individual arbitration. The arbitration will be conducted by a single arbitrator, and the arbitrator's decision will be final and binding.

14.4 Class Action Waiver

YOU AND CASHY KING AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You and Cashy King expressly waive any right to file a class action or seek relief on a class basis.

14.5 Exceptions

Notwithstanding the above, either party may bring a claim in small claims court if it qualifies, and either party may seek injunctive or equitable relief in court to prevent infringement of intellectual property rights.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Cashy King.

17. Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and Cashy King regarding the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and Cashy King.

BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE CASHY KING SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE LEGALLY BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE.
